出庭履行职务的人员，按照职业着装规定着装。但是，具有下列情形之一的，着正装：

（一）没有职业着装规定；

（二）侦查人员出庭作证；

(2) investigators appear in court to testify;

（三）所在单位系案件当事人。

(3) the unit to which it belongs is the party to the case.

非履行职务的出庭人员及旁听人员，应当文明着装。

 刑事在押被告人或上诉人出庭受审时，着正装或便装，不着监管机构的识别服。

人民法院在庭审活动中不得对被告人或上诉人使用戒具，但认为其人身危险性大，可能危害法庭的除外。
